Update to Traffic Crash (Dr Martin Luther King/Ortiz)

Update to Dr Martin Luther King/Ortiz traffic crash from August 8, 2020

On Saturday August 8, 2020 at approximately 9:59pm the Fort Myers Police Department received a call in reference to a traffic crash involving a pedestrian and a motorcycle, on SR 82 and Park 82 Drive. Upon officer’s arrival, they observed the pedestrian, who was later identified as Joseph Madden (DOB 04-19-1979), laying in the roadway with life threatening injuries. Officers also observed the driver of the motorcycle, who was later identified as Erion Fiametti ( DOB 01-17-1993) laying in the roadway with serious injuries.

Traffic homicide investigator Kristi Neroni responded to the scene to lead the crash investigation.

The investigation found that prior to the crash Madden pulled off the roadway due to a mechanical failure with his vehicle. Madden was accompanied by his family who were inside the vehicle at the time of the crash. The investigation found that Madden was physically in the westbound lanes of travel, holding jumper cables while trying to flag vehicles down to assist him.

Fiametti was traveling westbound, near two other vehicles that took evasive action to avoid hitting Madden. By the time Fiametti noticed Madden in the roadway it was too late to avoid striking him.

The investigation found Madden at fault in the crash, for violating the right of way of Fiametti. Madden was standing in the westbound lane of travel, adjacent to the bike lane, when he was struck by Fiametti who was driving a 2009 Yamaha motorcycle.

The impact resulted in Fiametti being ejected from his motorcycle. Madden lost his leg because of the crash, along with several other injuries.

Madden was also found to have a blood alcohol content nearly double the legal limit at the time of the crash.

Speed was not a factor in the crash. Fiametti did not have a motorcycle endorsement on his license and was cited.
