On Wednesday, February 12, 2014 at about 3:20 p.m. the Fort Myers Police Department received multiple calls in reference to an altercation involving the occupants of two vehicles traveling on Cleveland Avenue near Grace Avenue. Witnesses reported that the driver of a gold pick-up truck was ramming into a small two door gray vehicle. The callers further indicated that occupants of the gray vehicle were shooting at the gold truck.
Responding o\Officers located a small gray vehicle, matching the description provided by the callers, pulling into 2929 Broadway. The officers conducted a traffic stop on the suspect vehicle and detained the driver, Kyle Irvin (7/3/1992). The front seat passenger was identified as Rodrick Pasley (6/24/1977) and the rear seat passenger was identified as Jenny Carter (5/2/1991). When the Officers ordered Roddrick Pasley to exit the vehicle, an Officer saw a small black object fall from his lap onto the floorboard and the Officer discovered that it was a black handgun. All of the occupants of the gray vehicle were detained for the investigation.
Simultaneously, another responding Officer was flagged down at the intersection of State Road 82 and Broadway Avenue by Craig Spurlock, who was driving a gold Chevrolet pick-up truck. The Officer noticed that the vehicle had several bullet holes in the front portion of the truck. This vehicle matched the description of the gold truck involved in the incident. Officers brought Mr. Spurlock to 2929 Broadway and he positively identified the vehicle that Kyle Irving was driving as the same vehicle involved in the altercation with him on Cleveland Avenue. Mr. Spurlock reported that both Irving and Pasley fired a handgun at his vehicle during the altercation.
Detectives responded to the scene to further conduct the investigation. The investigation revealed Mr. Spurlock and Ms. Carter (husband and wife) were involved in an early domestic argument. Ms. Carter asked Kyle Irving and Rodrick Pasley to pick her up in the vehicle, so she could get away from Mr. Spurlock. At some point, Mr. Spurlock began chasing them in his gold Chevrolet truck. Mr. Spurlock rammed the driver's side of Irvin's vehicle with his truck and forced it off the roadway, near the intersection of Cleveland Avenue and Grace Avenue.
Detectives interviewed the involved parties and obtained statements from independent witnesses. Kyle Irvin and Roddrick Pasley were arrested and charged with Aggravated Assault with a Firearm, Discharging a Firearm from a Vehicle, and Shooting into an Occupied Vehicle. Additionally Pasley was charged with Possession of a Firearm by a Convicted Felon. Craig Spurlock was also arrested, charged with Aggravated Assault with a Weapon.
