The City of Fort Myers has an ordinance (Sec. 34-61) that states it is unlawful for any person to operate an alarm system without a valid user permit. Violation of the ordinance is a second degree misdemeanor punishable as provided in Florida State Statute Chapter 775.
All alarm user permits expire on December 31st of each year and must be renewed no later than January 1st of each year. Renewal permits will be issued after completion of an application form provided by the Police Department and payment of a $35 renewal fee. Permits for premises without false alarms during the proceeding permit period will be renewed upon completion of an application but without any renewal fee. If a business has one or more alarm systems protecting two or more separate structures having different addresses a separate permit will be required for each structure.
The ordinance also states that four false alarms within any calendar year is excessive and constitutes a public nuisance. The activation of five or more false alarms within a calendar year will result in a service fee and/or revocation of the permit according to the following schedule:
